DPDP Rules Revolutionize Data Rights and Consent Framework, ETCIO

The DPDP Rules have sought to introduce a stronger consent framework as well as expanded data subject rights, thus, bringing individuals to the center of data governance. DPDP Rules bring in stronger consent framework and user rights

The DPDP rules raise the bar on consent as well as data subject (data principal) rights. Notices to individuals must be clear, standalone as well as in plain language. Additionally, there should be accessible methods for data principals to withdraw consent, correct data as well as lodge complaints with the DPB.

However, some cybersecurity leaders provide a different perspective.

“Little has been clearly defined so far, apart from the salaries of the Data Protection Board’s chairperson and members. Key aspects such as the role and structure of the SDF remain unclear, and greater certainty around data subject rights and consent will only emerge once the Board is operational. For now, the primary obligation for organizations is to issue privacy notices to all data principals within 18 months, a substantial task, though the timeline appears reasonable,” says Dr. Durga Prasad Dube Ph.D., Global CISO and Executive Vice-President at Reliance Industries Ltd.

New DPDP rules will have important ramifications for enterprises

Businesses will need to rethink and re-engineer how they seek consent. More user-friendly and transparent interfaces will be needed, including consent withdrawal. Contractual models may probably change. Organizations may need to rely on third-party consent managers, or build their own capabilities. These new provisions can spell significant ramifications for consumer-facing businesses (e.g., apps, social media, e-commerce). These provisions and obligations may lead to significantly changed UX as well as data-flow design.

Some industry views suggest that the DPDP framework will continue to evolve over time, gradually becoming more refined as real-world incidents, breaches, and legal cases emerge. Each enforcement action and compliance challenge will help clarify grey areas, prompting updates to rules, guidance, and industry best practices. In practice, this means the law will not remain static; instead, it will mature through continuous interpretation and adjustments driven by experience.

Enterprises can expect periodic revisions and more detailed expectations as regulators respond to practical scenarios and sector-specific issues.
